Gaming Industry Survey: Prescribed Games

Under Section 86 of the Gambling Regulation Act 2024, the GRAI is required to prescribe a list of the games that may be provided by a licensee under a gaming licence.

To support this process, the GRAI has worked with external subject matter experts and other regulators to develop what we believe should be considered “prescribed” for the purposes of gambling regulation and a list of draft categories of ‘Prescribed Games’, which are available here.

We are now seeking the views of the industry and other relevant stakeholders, at this early stage, to ensure that the definition of a ‘Prescribed Game’ is clear, workable, and reflective of both regulatory objectives and industry realities. We also recognise that definitions and interpretations may differ across product types.

Along with providing feedback on the proposed categories, we welcome industry’s views and insights into the features, mechanics, and circumstances that may determine whether a game should be considered “prescribed” for the purposes of gambling regulation. Reflecting the different commercial realities, there are two surveys, one for remote gaming and one for in-person gaming. Our surveys aim to capture practical perspectives from the industry, including operational, technological, and consumer-facing considerations.

The insights gathered will inform the drafting of regulations to define ‘Prescribed Games’. The draft regulations will subsequently be published for formal public consultation, providing further opportunity for input from all interested parties.

Confidentiality & Use of Information

All responses submitted through this survey will be treated with the utmost confidentiality and in accordance with the Data Protection Act 2018, the General Data Protection Regulation (EU) 2016/679, and the Gambling Regulation Act 2024.

We will collect the following personal data from you: Name and Email Address. Additionally, we will collect operational data regarding your games offerings; however, the information gathered will be anonymised and will not be attributed to any individual respondent or organisation. No personally identifiable data will be published or disclosed. The anonymised results will be used exclusively to support the GRAI in developing regulatory guidance and/or policy advice related to the classification of “Prescribed Games”. Your personal data (name and email address) will be retained in accordance with our GRAI organisational policies. The data you provide will be processed under:

  • Consent: By completing this survey, you consent to the processing of the personal data you provided for the stated purpose

  • Legitimate Interest: GRAI has a legitimate interest in using anonymised results to develop regulatory guidance and policy advice

This survey is an informative consultation and is not part of any enforcement or investigatory process. Participation is entirely voluntary, and responses will only be used to inform the GRAI’s understanding and approach to its regulatory responsibilities.
